The SAFE Act (Secure Ammunition and Firearms Enforcement Act, 2013) is New York’s assault weapons ban. It restricts semi-automatic rifles, shotguns, and pistols with certain features. Here’s what we can ship to New York.
SAFE Act Feature Test
A semi-automatic rifle is classified as an “assault weapon” in NY if it has a detachable magazine AND one or more of these features:
- Folding/telescoping stock
- Pistol grip protruding conspicuously
- Thumbhole stock
- Bayonet mount
- Flash suppressor/grenade launcher mount
- Vertical forward grip
Pre-SAFE Act rifles with grandfather status may be owned but not transferred to new owners.
What We CAN Ship to New York
- SAFE-Act compliant AR-15s — featureless (no pistol grip, no flash hider, no vertical forend)
- Fixed-magazine AR-15s — with fixed 10-round magazines
- Bolt action rifles
- Shotguns (not semi-auto with pistol grip)
- Handguns on NY permit
- 10-round magazines
- Ammunition (with NY bg check)
What We Cannot Ship to New York
- Standard AR-15/AK configurations (most common setups)
- Magazines over 10 rounds
- “Assault rifles” with 2+ banned features
- Semi-auto shotguns with pistol grips
NY Ammunition Background Check
As of September 2023, New York requires a background check for all ammunition purchases. We cannot currently ship ammunition directly to New York consumers — it must go through a NY ammo dealer.
NY Firearm Licensing
New York requires a handgun license for pistol ownership. Licenses are issued by the county of residence and can take 3-6 months to process. Rifles and shotguns don’t require separate licensing but are restricted by SAFE Act configuration rules.
