Agreement
By accessing or purchasing from georgiagunshops.net, you agree to these Terms of Service. If you do not agree, do not use the site. Georgia Gun Shops is a federally licensed firearms dealer (FFL) operating from Atlanta, Georgia, and ships to buyers in all 50 U.S. states via authorized FFL-to-FFL transfers.
Eligibility
To purchase a firearm, you must be at least 21 years of age (18 for long guns where permitted by federal and state law), a U.S. citizen or lawful permanent resident, not prohibited from possessing firearms under 18 U.S.C. § 922(g) (no felony convictions, no domestic violence misdemeanors, no dishonorable discharge, no restraining orders, no adjudications of mental defect, no unlawful drug use, no active warrants, not a fugitive), and able to legally receive the firearm in the state to which it is shipped. Lying on a Form 4473 is a federal felony.
FFL Transfer Requirement
Every firearm sold through this site ships to a Federal Firearms License holder of your choice — not to your home, office, or post office box. You select the receiving FFL at checkout by providing the dealer’s name, address, phone number, and license number (or having the dealer email a copy of their FFL to us). The receiving FFL will contact you when the firearm arrives, complete ATF Form 4473, run a background check via NICS or state equivalent, and — if approved — transfer the firearm to you. The receiving FFL typically charges a transfer fee ($25-$75) that is not included in our prices and is paid directly to them.
Prices, Orders, and Availability
All prices are in U.S. dollars and exclude shipping, FFL transfer fees, and any state or local taxes. We reserve the right to correct pricing errors, refuse or cancel any order, and limit quantities. Placing an order does not guarantee acceptance; we confirm orders by email after reviewing inventory and eligibility. If we cannot fulfill an order, we refund the full amount.
Payment
We accept credit and debit cards via our payment processor. Payment is authorized at checkout and captured when we ship. If payment is declined or reversed after shipment, we reserve the right to recover the product, costs, and any associated fees.
Shipping and Delivery
See our Shipping Policy for carrier, timing, and state restriction details. Firearms ship via insured, signature-required delivery to your chosen FFL. Title and risk of loss transfer to you upon delivery to the FFL.
Returns
See our Returns Policy. Firearms transferred through a Form 4473 cannot be returned for refund under federal law except for manufacturing defects. Non-firearm accessories are returnable within 30 days subject to a restocking fee.
State Law Compliance
You are responsible for ensuring that any firearm or accessory you order is legal to possess in your state of residence. We check destination state against a compliance matrix (California roster, New York SAFE Act, Massachusetts handgun approval list, New Jersey magazine limits, Washington I-1639, Illinois FOID, etc.) and will cancel orders that cannot lawfully ship. Refunds issued within 3 business days.
Warranty
Firearms carry the manufacturer’s warranty. We are not the warrantor. Manufacturer-authorized service centers handle warranty claims. We assist by providing proof of purchase and, where applicable, shipping product to the manufacturer on your behalf.
Intellectual Property
All site content (text, images, product descriptions, logos) is owned by Georgia Gun Shops or licensed from manufacturers. You may not copy, reproduce, or distribute content without written permission.
Limitation of Liability
To the fullest extent permitted by law, Georgia Gun Shops is not liable for indirect, incidental, consequential, or punitive damages arising from the use or misuse of any product purchased. Our maximum liability for any claim is the purchase price of the product giving rise to the claim.
Indemnification
You agree to indemnify and hold Georgia Gun Shops harmless from any claim arising from your misuse of a firearm or accessory, violation of these Terms, or violation of federal, state, or local law.
Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws principles. Any dispute is resolved in the state or federal courts located in Fulton County, Georgia.
Changes
We may update these Terms at any time. The updated version takes effect on posting. Continued use of the site constitutes acceptance.
