Georgia Gun Laws: A Plain-English Guide for 2026

Georgia is one of the simpler states in the country for buying and owning a gun, and since 2022 it has also been one of the simpler ones for carrying. This guide walks through what actually applies when you buy from a dealer, what the state asks of you, and the handful of rules that still catch people out. It is general information, not legal advice, and it is current as of September 2026. The statutes live in Title 16, Chapter 11 of the Official Code of Georgia Annotated, and the Georgia Attorney General and the county probate courts publish the licensing side.

Buying a gun from a dealer

There is no permit to purchase in Georgia, no firearm owner card, no state registry and no state waiting period. When you order from our online shop, the firearm ships to a licensed dealer you choose and you complete the transfer in person at that counter.

At the dealer you will:

  • Show a valid government photo ID with your current Georgia address.
  • Fill in the federal ATF Form 4473.
  • Wait while the dealer runs a background check through the FBI's National Instant Criminal Background Check System.
  • Pay the dealer's transfer fee, which varies from shop to shop, so ask before you pick your FFL.

Georgia is not a point-of-contact state. The dealer contacts the FBI directly rather than a state agency, and most checks come back in minutes. If the check returns a delay, federal law lets the dealer transfer after three business days, but many dealers choose to wait for a definite answer.

Age limits

Federal law controls dealer sales. A licensed dealer may sell a handgun only to a buyer who is 21 or older, and a rifle or shotgun only to a buyer who is 18 or older. Georgia layers its own rule on top for possession: under O.C.G.A. 16-11-132 a person under 18 generally may not possess a handgun, with exceptions for hunting or fishing with a valid license, target shooting at an established range, an organised competition, a hunter education or firearms safety course, and possession at home or on family property with a parent's permission.

Private sales

Georgia does not require a background check on a private sale between two residents who may each lawfully possess a firearm. That is not a licence to be careless. It remains a serious offence to transfer a gun to someone you know or should know is prohibited, and running the sale through a licensed dealer is the only way to get a documented check. Many private sellers in Georgia meet at a dealer for exactly that reason.

Who cannot have a gun in Georgia

The prohibited categories track federal law closely: felony convictions, fugitive status, unlawful drug use, certain domestic violence convictions, active protective orders, and adjudications relating to mental competency, among others. O.C.G.A. 16-11-131 covers felons and first offenders. If you are unsure whether an old case still counts, talk to a Georgia lawyer before you order anything.

Carry: Georgia is a permitless carry state

Senate Bill 319, effective April 2022, rewrote O.C.G.A. 16-11-126 around the idea of a lawful weapons carrier. That means an adult who is eligible for a Georgia Weapons Carry License and is not otherwise barred from having a gun. A lawful weapons carrier may carry a handgun openly or concealed, on foot or in a vehicle, without applying for anything. Long guns may be carried by anyone not prohibited from possessing one.

The licence has not gone away, and there are good reasons to hold one. Other states recognise the Georgia licence under reciprocity, the Attorney General maintains the list, and the licence can smooth over questions in the field. Our licence guide covers the application in detail.

Where you still cannot carry

O.C.G.A. 16-11-127 keeps a list of restricted places. In plain terms, leave the gun behind when you are going into:

  • A courthouse.
  • A jail, prison or detention facility.
  • A state mental health facility that admits involuntary patients.
  • The grounds of a nuclear power facility.
  • Within 150 feet of a polling place while voting is going on.
  • A government building where entry is screened by security personnel, including at least one certified peace officer. If there is no screening and the building is open for business, a lawful weapons carrier may carry.

Places of worship are handled separately: the governing body of the congregation decides. Private property owners may also forbid firearms on their premises, and refusing to leave when asked becomes a trespass matter under O.C.G.A. 16-7-21.

Guns in vehicles

A lawful weapons carrier may carry a handgun or long gun in a private passenger vehicle, loaded or unloaded, openly or out of sight. Anyone who is not prohibited from possessing a firearm may keep one in their own home, car or place of business. Employers and private landowners can still set rules for their own parking areas.

School safety zones

O.C.G.A. 16-11-127.1 creates a school safety zone covering school buildings, grounds, buses and school functions. The rules are strict and the exceptions are narrow, and they changed with the carry reforms, so read the current text before you drive into a school car park with a gun in the console. The safest habit is to leave the firearm secured off school property.

What ships where

Handguns, rifles and shotguns ordered from our gun shop ship to the FFL you name, never to your house. You finish Form 4473 and the NICS check there, and the dealer hands the gun over when the check clears. Ammunition, optics, magazines, holsters and most parts ship straight to your address in Georgia, and an adult signature may be required on delivery.

Georgia does not restrict magazine capacity, does not require an ammunition permit and does not tax ammunition separately.
